  1. Acceptance of Terms and Conditions By using our web design and hosting service, you agree to and undertake to comply with the following terms and conditions. If you do not agree with any of these terms, we kindly ask you not to use our services.
  2. Website Delivery and Modifications The final delivery of the website is considered completed when it is published and available with the corresponding domain, to be visible on the web. From that moment on, any additional required modifications should be requested from the Fourier team through a quote request or by contracting a Maintenance Policy, subject to the current rates and conditions.
  3. Functionality Guarantee We commit to ensuring the optimal functionality of the website within the duration of the service contract. However, it’s important to note that there are external variables that can affect performance, such as server operation, hacker attacks, viruses, and the user’s internet service quality. In case of any technical issues, we undertake to provide support and resolve them to the best of our abilities.
  4. Website Backup As a security measure, we will perform a complete backup of the website once a month. This allows us to recover information in case of data loss or unforeseen technical failures. However, if the website is hosted with another hosting service provider managed by the client, it will be the client’s responsibility to make the corresponding payments to keep the hosting and domain up to date. This is necessary to ensure the website is available at all times. We will not be responsible for issues arising from lack of payment or client’s management of hosting and domain.
  5. User Access and Modifications When the user is provided with the necessary username and password to access and modify the website, it will be understood that the client assumes full responsibility for any changes made. In this regard, by making direct modifications to the website, the user will automatically lose any warranty offered by our service.
  6. Paid Plugins In some cases, we may recommend the use of paid plugins to enhance website functionality. In such cases, the client will be responsible for acquiring and directly paying the monthly fee or license corresponding to the plugin’s brand. Fourier is not responsible for the costs associated with paid plugins or the transactions between the client and the plugin’s brand. Any issues or inquiries related to the use, billing, or support of the plugin should be handled directly with the supplying brand. Fourier will provide guidance and technical assistance in the installation and configuration of the plugin, but the financial and contractual responsibility will lie with the client.
  7. SEO Positioning We commit to including optimization techniques and elements in the website to improve its positioning on search engines (SEO). However, we do not guarantee that the website will appear in the first position of search results, as this depends on the algorithms and variables of each search engine. Nevertheless, we will make our best efforts to enhance the website’s positioning in search results.
  8. Intellectual Property All works created by our design and development team, including the website, its graphic elements, and content, are protected by intellectual property laws. The ownership and authorship rights of the website and its components belong to Fourier, unless otherwise agreed upon in a specific contract.
  9. Privacy and Data Protection We commit to respecting the privacy of our clients and protecting their personal data in accordance with our privacy policy. The collection, use, and storage of data are carried out in compliance with applicable laws and regulations.
  10. Contract Termination In case of contract termination, the client may request the delivery of files containing the website’s code by paying the corresponding amount for 8 hours of Maintenance Policy. Once the payment is made, we commit to delivering the files within a period of 72 business hours.
  11. Limitation of Liability Under no circumstances shall we be liable for direct, indirect, incidental, special, or consequential damages, loss of profits, or business interruption resulting from the use or inability to use our services, even if we have been previously advised of the possibility of such damages.
  12. Applicable Law and Jurisdiction These terms and conditions are governed and interpreted in accordance with the laws of the country in which we operate. Any disputes arising in connection with our services will be subject to the exclusive jurisdiction of the courts of said country.
